1. Acceptance of Terms
By creating an account and using HeloMate, you affirm that you are at least 18 years old and capable of entering into a binding agreement. You agree to comply with these Terms and all applicable local, state, national, and international laws, rules, and regulations.
2. Services Provided
HeloMate provides a platform for users to connect through audio and video calls to build friendships and engage in conversations. The App facilitates:
User Profiles: Creation and management of personal profiles including avatar, display name, and languages spoken.
Communication: Real-time audio and video calls between users.
Monetization (for specific users): A system where some users (currently female users) can earn coins for their interactions, which can then be withdrawn as money after KYC verification.
Ratings and Reviews: Users can rate and review their interactions.
Transaction History: Users can view their past coin transactions and session history.
3. User Accounts
Account Creation: You must register for an account using your email address and a password. You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account.
Accurate Information: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
Account Security: You must notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this section.
Account Deletion: You may delete your account at any time through the App's Profile settings.
4. Payment and Earnings
Coin Purchase: Users (currently male users) can purchase virtual coins through the App's wallet using Razorpay. The cost of coins is clearly displayed within the App and may vary based on package size. All coin purchases are final and non-refundable, unless otherwise required by law.
Call Charges: Audio and video calls consume coins at a rate specified within the App (e.g., 60 coins/minute).
Earnings (for female users): Female users can earn coins based on the duration and type of calls they engage in.
KYC Verification for Withdrawals: To withdraw earned coins as money, female users must complete a Know Your Customer (KYC) verification process by providing their full name as on PAN card, PAN number, bank account holder's name, bank name, and bank account number. Withdrawals will only be processed upon successful KYC verification.
Coin Value: The monetary value of coins for withdrawal purposes may vary and is determined solely by the App administration (SLV TECHNOLOGIES). We reserve the right to change the coin conversion rate at our discretion, with prior notice if significant.
Withdrawal Process: Withdrawal requests will be processed as per the timelines and procedures communicated within the App.
5. Restricted Content and User Conduct
You are solely responsible for the content you share during calls and your overall conduct on the HeloMate platform. We have a zero-tolerance policy for certain types of content and behavior. You agree NOT to:
Hate Speech: Engage in or promote hate speech, discrimination, or bigotry against any group or individual.
Harassment or Bullying: Harass, bully, threaten, or intimidate other users.
Explicit or Pornographic Material: Share, display, or promote explicit or pornographic material, especially if prohibited by the jurisdiction.
Illegal Activities: Use the App for any illegal purpose or in furtherance of any illegal activity. This includes, but is not limited to, promoting violence, drug use, or fraudulent schemes.
Impersonation: Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
Intellectual Property Infringement: Post, transmit, or otherwise make available any content that infringes upon the intellectual property rights of others, including copyrights, trademarks, or other proprietary rights.
Spam or Unsolicited Commercial Content: Send unsolicited or unauthorized advertising, promotional materials, spam, or any other form of solicitation.
Malware or Harmful Code: Transmit or upload any malware, viruses, worms, or any other code of a destructive or disruptive nature.
Privacy Violation: Collect or harvest any personally identifiable information from the App from other users without their express consent.
Misrepresentation: Misrepresent yourself or the services you provide, including any deceptive practices to induce users into calls.
Financial Services / Gambling: Engage in any form of real-money gambling, games, contests with real-money payouts, or offer financial services through the App.
Health Content: Provide health advice, diagnoses, or treatments, or promote unproven medical claims.
AI-Generated Content Misrepresentation: If any content is AI-generated, it must be appropriately disclosed if there is any potential to mislead users.
Unauthorized Use of System Functionality: Engage in any behavior that mimics or interferes with system functionalities for malicious purposes (e.g., ad fraud).
The application reserves the right to suspend or terminate accounts violating these guidelines, without prior notice.
6. User Generated Content (UGC)
Responsibility for UGC: You are solely responsible for the content you create, transmit, and display while using the App.
Content Moderation: We may, but are not obligated to, review, monitor, or remove UGC that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.
No Obligation to Back-Up: We are not responsible for backing up any UGC.
7. Intellectual Property
The HeloMate name, logo, design, and all associated intellectual property are owned by SLV TECHNOLOGIES. You agree not to copy, modify, distribute, sell, or lease any part of our Services or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.
8. Disclaimers and Limitation of Liability
"As Is" Basis: The Services are provided on an "as is" and "as available" basis. SLV TECHNOLOGIES makes no warranties, express or implied, regarding the Services, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
No Guarantee of Availability: We do not guarantee that the Services will be uninterrupted, secure, or error-free.
User Interactions: We are not responsible for the conduct of any user on the platform. You are solely responsible for your interactions with other users.
Limitation of Liability: To the maximum extent permitted by applicable law, SLV TECHNOLOGIES shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
Your access to or use of or inability to access or use the Services;
Any conduct or content of any third party on the Services;
Any content obtained from the Services;
Unauthorized access, use, or alteration of your transmissions or content.
9. Indemnification
You agree to indemnify and hold harmless SLV TECHNOLOGIES and its affiliates, officers, agents, and employees from and against any claim, suit, or action arising from or related to your use of the Services or violation of these Terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs, and attorneys’ fees.
10. Governing Law and Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of India, specifically the laws of Telangana, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity or termination, shall be referred to and finally resolved by arbitration in Hyderabad, Telangana, India, in accordance with the provisions of the Arbitration and Conciliation Act, 1996. The language of the arbitration shall be English.
11. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised Terms.
